Terms of Sale & Subscription

These Terms of Sale apply to the subscriptions and purchases offered in the Powalia app, published by Palta Negra LLC (see “Legal notice”). They supplement the “Terms of Use”.

1. Free access

15 free analyses in total, with no time limit (not 15 analyses per month or per day). Once this quota is used up, a subscription is required to continue paid analyses.

2. Monthly subscription

€24.99 per month, with automatic monthly renewal, no minimum commitment period, cancellable at any time. Cancellation takes effect at the end of the period already paid for, unless otherwise required by law or decided by the platform.

3. Annual subscription

€199 per year, with automatic annual renewal, cancellable before the renewal date; access is maintained until the end of the paid period. For the annual subscription, written information reminding you of the option not to renew and of the deadline for non-renewal is sent within the applicable legal time frame, at the earliest three months and at the latest one month before that date.

4. Prices

Prices are stated inclusive of all taxes where required by regulation. The price and currency displayed in the App Store or Google Play at the time the purchase is confirmed prevail; local prices may vary depending on currency, taxes and platform rules. The annual amount actually charged (€199) is displayed as a priority and is not presented as a monthly instalment.

5. Payments

Digital purchases made in the app are processed via Apple In-App Purchase or Google Play Billing. Apple and Google collect payment data directly under their own terms. Powalia receives only the information necessary to verify the receipt, activate access and manage the subscription status. Powalia does not use a third-party native payment solution (for example Stripe) for in-app purchases in the mobile application.

The online programmes in the shop are one-off purchases, separate from the subscription. When a programme is sold in the app, Apple or Google in-app payment applies. Access to the programme is then provided on Systeme.io; only your identity, email address, purchased programme and technical activation data are transmitted. Powalia does not transmit to Systeme.io the health data you enter in the app.

8. Promotional codes and complimentary access

Promotions or codes may be offered, and access may be granted free of charge as part of a competition, a partnership, a support programme or a professional licence. The specific conditions announced for the offer concerned apply.

9. Right of withdrawal

Subscription (digital service). Consumers in the European Union are in principle entitled to a 14-day withdrawal period. If you request immediate performance of the service before the end of that period, your express request is collected; in the event of withdrawal after performance has begun, any amount due corresponds to the service already provided, in proportion to the price, where the regulation allows.

Digital programme provided immediately. For digital content without a physical medium, the loss of the right of withdrawal can only result from the combination of three conditions: (1) your prior express agreement to begin immediately, (2) your express acknowledgement of the loss of the applicable right of withdrawal, and (3) confirmation of the contract on a durable medium. The loss of the right of withdrawal is therefore not automatic upon payment alone.

10. Refunds

Your statutory rights are preserved. Refund requests relating to a purchase charged by a platform are, where applicable, handled through that platform (Apple’s App Store or Google Play) under its rules. For any claim addressed to Powalia: contact@powalia.com.

Any claim relating to a purchase or a subscription may be addressed to contact@powalia.com. Powalia endeavours to seek an amicable solution before any litigation.

11. Governing law and disputes

These Terms of Sale & Subscription are governed by French law. This choice does not, however, deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence where applicable. In the event of a dispute, the parties endeavour to seek an amicable solution first. Failing agreement, the competent courts are determined in accordance with the mandatory rules applicable to consumer protection.
